Raja Petra decision on Feb 13

Raja Petra decision on Feb 13 PDF Print E-mail

(NST) - Political commentator Raja Petra Kamarudin will have to wait until next month to know the status of the defamation charges against him.

High Court Judicial Commissioner Zainal Azman Ab Aziz will deliver his decision on Feb 13. He fixed the date yesterday after hearing submissions.

Raja Petra, 59, is facing three counts of criminal defamation over a statutory declaration he made about the murder of Mongolian translator Altantuya Shaariibuu.

He is alleged to have defamed the deputy prime minister's wife, Datin Seri Rosmah Mansor, Lt-Col Norhayati Hassan and her husband, Lt-Col Abdul Aziz Buyong, by making a libellous statement in the declaration, which he affirmed on June 18, when he knew that it would tarnish their names.

He was alleged to have committed the offences at High Court Civil 5 in the Jalan Duta court complex at 10.25am on June 18 last year.
His counsel Manjeet Singh Dhillon yesterday submitted that the prosecution's application to transfer the case from the magistrate's court to the Sessions Court had exposed Raja Petra to a potentially heavier punishment.

"The charges faced by Raja Petra carry a maximum two years' jail, or fine, or both. A magistrate has the jurisdiction to pass sentences up to five years' jail, a fine of up to RM10,000 or whipping up to 12 strokes.

"In contrast, a Sessions Court judge can pass any sentence other than the death sentence.

"Also, there is no cap on the maximum fine that the judge can impose."

Manjeet said the transfer order granted by the magistrate's court was unconstitutional as it had breached the equality provision under the Federal Constitution.

"There is clear discrimination whereby Raja Petra is being singled out for harsher punishment."

This is visible evidence of what has been reported to have been going on ever since the BN lost shamefully last March - the systematic detention and torture of Indians by the PDRM, rude service at other gormen service counters and so on.

The BN has lost all moral rights and no longer deserves to represent the people of Malaysia. They lack the class to step down when they are no longer needed. Instead they cheat and threaten in order to stay in power. The only thing they have not done yet is to bring out the armed forces. This may well have been why the Defence Ministry was so quickly transferred into safer hands.

The Indians are paying the price for having provided the critical swing votes to PR and changing the face of our politics. What will everyone else do now?

23 vigil heroes to be charged on Friday, 23rd January, 2009

January 21, 2009

Just got a call from Sunny Lim, one of the 23 vigilers who are due to be charged in court in relation to the impromptu vigil on 9th November, 2008.

He got a call from ASP Hazlinda a little while ago to inform him that all the 23 will now be charged on Friday, 23rd January, 2009, at 9am, and not tomorrow as earlier indicated.

ASP Hazlinda informed Sunny that all the other 22 would also be informed by telephone.

I got the impression in my phone conversation with Sunny that there might be some confusion or uncertainty as to the matter of bail, so here goes.

For those being charged on Friday, please arrange to have someone who is prepared to stand as your bailor come along with you to court on Friday.

After the court has set the amount for bail, the court registry will issue a document which will detail your charge registration number, the particulars of your bailor, and the bail amount set by the court.

With that document, your bailor will have to head to the nearest bank, open a savings account and deposit the bail sum. The saving account book issued will then have to be handed over to the court registry.

To the rest of you out there, please make time to come to the PJ Magistrates Court on Friday, 23rd January, 2009, before 9am, to show solidarity and support for our 23 heroes.

A ‘help raise bail funds’ sms went out this morning. As you can see, cash will be needed to assist those being charged to make up their bail. Those of you who would like to help and are able to make it to court on Friday, please bring cash.

Authorities tighten screws on ISA vigil participants

Authorities tighten screws on ISA vigil participants

Fr Paulino Miranda, the parish priest of the Catholic Church of the Divine Mercy in Shah Alam, is among those who have been asked to appear in court on Thursday to be charged in connection with their participation in an Abolish ISA vigil/Bersih anniversary commemoration.

Paulino was among 23 arrested during the vigil on 9 November 2008 and later released on police bail the same night. Their bail was not extended when they reported at the police station on 24 November. But since last Friday, several of them including Miranda have received phone calls from the police informing them that they will be charged at the PJ Magistrates Court at 2.00pm on 22 January. Among those who received phone calls were a few vigil participants who were campaigning in the Kuala Terengganu by-election.

The authorities appear to be tightening the screws on those participating in the Abolish ISA vigils.

In Kuala Terengganu, I ran into Bukit Mertajam MP Chong Eng, who told me she had received a phone call from the police informing her that they want to record her statement in connection with her participation at one of the Penang Abolish ISA vigils.

The emcee for one of the Penang Abolish ISA vigils, Paula Khoo, is due to report to the police on the third day of Chinese New Year to find out what action, if any, police want to take. When she last reported to the police, they extended her police bail.

The weekly Abolish ISA Masses have resumed at the Church of the Immaculate Conception in Penang. The first Mass of 2009 was held last Wednesday. Another Mass is expected to be held this Wednesday.

Police Stops the 14th PJ Vigil

01.13.2009 | Author: Administrator | Posted in Extreme, Rough Voices

PETALING JAYA, 11 Jan - Police ordered the participants of the 14th Anti-ISA Vigil at MBPJ to disperse minutes after the event had started on the grounds that they had no permit.

The vigil began at around 8.15pm but about five minutes later the OCPD of PJ ordered the participants to disperse. There were over 200 police personnel, riot police and plain clothes personnel. Three FRU trucks were parked by the side of Civic Hall.

“The authorities care a lot for the safety of the rakyat,” reports Rakyat@work, tongue in cheek. “They sent more than two police personnel for every vigil participant.”

It is a case of too little yet never too late, that is how I would describe the efforts and attempts by Pak Lah to institute reforms in Umno and Barisan Nasional, after 22 years of excess under the regime of Tun Dr Mahathir. The excesses of the previous regimes cannot and are unlikely to be reversed through the changes Pak Lah hopes to institute in the next few months before departing as both head of party and prime minister.

The resistance from individuals within Umno is Dr Mahathir’s gift to this nation of ours. That is why it is no wonder that Dr Mahathir is as aggressive as he is, in his campaign to unseat Pak Lah.

His latest ranting about the results of the Kuala Trengganu by-election is only a follow up to his attempt to sabotage the candidate long before election day.

His current attempts to smear Pak Lah’s name is only another of his strategic moves to hasten Pak Lah’s departure and halt the necessary reforms that Umno, Barisan Nasional and this country badly needs.

It is incumbent on everyone who loves Umno, BN and this country to not allow him to succeed. It is obvious that Dr Mahathir is now trying his best to get Datuk Seri Najib Abdul Razak under his thumb.

His present call for people not to blame Najib is an attempt to drive a wedge further between Najib and Pak Lah, a Machiavellian manoeuvre only Dr Mahathir can execute with deadly intent — masked behind a façade of innocence.

The result of the Kuala Trengganu by-election can be a good outcome for Umno and BN only if it is not derailed by Dr Mahathir and individuals aligned to him who are trying their best to deflect blame for the defeat on to an individual..

The results of the Kuala Trengganu by-election is an opportunity for introspection, for reform within BN, it should not be allowed to be turned into another strategic move by Dr Mahathir and his merry gang to exert their will on Umno and Barisan Nasional.

If Umno is willing to listen to the people, it will know that the changes Pak Lah has advocated since the March 2008 General Election are slowly but surely beginning to bear fruit.

There is the yearning on the ground that these changes continue. Pak Lah and Najib can make a good team, if only they can agree to a separation of roles.

This is a win-win combination with no losers, except for certain individuals who find reform a threat to the ‘business as usual’ ethos.

All is not lost, if there is one lesson to be learnt here is that the country needs to leave the old behind and move forward to embrace the new.

It may be time to consider various proposals to face the coming hardships, both economic and political.

It appears the days where one man is called upon to fulfil various responsibilities may be at its end.

For better efficiency and check and balance, we may need to have different persons as head of political parties and government.

This way, political parties can hold on to their ideologies without forsaking a Malaysian public that is crying out for impartiality.

A very will analysed article. Mahathir's hatred and continued sabotage of Pak Lah's administration is for 2 reasons:

1) Pak Lah's refusal to carry on/implement the long list of mega projects set up by Mahathir for himself and his cronies for the future 9th Malaysia Plan just before leaving office. Pak Lah scrapped the whole thing and this good action though saved the nation billions of ringgit, it rendered Mahathir's cronies without money and Mahathir maha angry

2) Khairy Jamalludin's action in revealing the truth about the 8th Malaysia Plan empty coffers left behind by Mahathir's regime. They finished it and KJ revealed it and Mahathir became maha angry again hence the revenge against Pak Lah at every step inc KT.

Now, can you all see the actual reason? Do you think that Pak Lah should resign and hand it over to Najib on a platter?

Good write up, but hilarious because it comes from a member of a running dog component of BN, i.e. Gerakan.

Stephen Doss' running dog party helped perpetuate Mahathir's 22 years of malpractice, and this poodle only learns how to growl at the old man when he is not holding the leash anymore.

Go sit in your corner and be a good dog, Fifi.

Let Umno implodes, there is better life ahead for Malaysians without Umno. We still have PAS, PKR and DAP.

Guess it's over, call it a day............sorry we have to end this way. Umno sobs!

What are you saying?
The main reasons AAB was unable to carry out the Reforms promised in 2004;

i) To eradicate corruption and uphold justice means The BN will be totally wiped out, as everyone is corrupt and unjust.
ii) AAB is too soft and passive a leader to enforce this on the party members, instead joining them. Can sleep and still earn.
or
iii)It's all Sandiwara

Any Reform will be up to us Rakyat now, and also by selecting a leader and party to see them through!

Still, he did enough and revealed enough to let unite the people.. but against the BN.
Better than the criminals before and (supposedly) after him.

When PR forms the next government, the very first thing they should do is to put all current and past leaders of BN on trial for corruption.
And if their family benefit financially, this should be taken away as well.

PR must send a strong message with a clear intent on instituiting a clean and transparent administration. They must not hesitate to instigate criminal proceedings against past leaders.

If Umno is willing to listen to the people, it will know that the changes Pak Lah has advocated since the March 2008 General Election are slowly but surely beginning to bear fruit.

You mean fruits with maggots?
The tree's rotten to the roots and has to be fell.
The correct message will be to ignore DrM,UMNO and BN for the sake of the future of Malaysia.
Comprendo ?

We like his last two lines. . Imagine the possibilities!

For better efficiency and check and balance, we may need to have different persons as head of political parties and government.
This way, political parties can hold on to their ideologies without forsaking a Malaysian public that is crying out for impartiality.

Najib as head of Umno, but not head of government! Yes, definitely better!

My suggestions
1.UMNO must unclasp itself from MM and his agents in UMNO,
2. Stop all development. Divert all funds to no. 3 below.
3. Divert attention in total to make rakyaat's life better. Take into consideration all detail.
4. Any development which is related directly to no. 3 should be implemented.
5. Seriously and consistently pursue to eradicate all vice acts, ie corruption, etc.
6. Enrich the rakyaat, any which ever way the government can.
7. Pension off all elders of the party and bring in the younger ones as ministers etc. The pensioners are still members of the party but do not hold position in the government.
etc etc etc
Is this possible?
I doubt they will even try.
So be it.
So it is up to DSAI then.
Please take over before march 09.

Shame on you, Doss. You were once a brave young man fighting the establishments. You would risk being detained for raising many sensitive issues that rakyat felt were of great concern to them. But I am sad to read the above article. AAB's reforms were, at most, a joke. Remember the police reports made by journalists recently regarding RM300 Ang Pows?? MACC has closed the file, FYI.
