Sorry guys and gals. I am shuttling between the various courts and my many lawyers’ offices that I have no time to write a ‘proper’ article. Next Monday is a most crucial day for me when it would determine whether I remain a free man -- at least for the next few months while I fight my various criminal indictments -- or I get sent back to Kamunting. Until then, please ‘feast’ on my response to the current Perak political crisis.

I did say in my previous article in this same column on 14 February 2009, The show is not over till the fat lady sings, as follows:
The Sultan had two choices. One would be to allow DAP, PKR and PAS to combine their seats and form a LOOSE coalition and probably see it collapse within six months due to crossovers. The second would be to allow Barisan Nasional to form the government and probably see it collapse within six months due to a vote of no confidence passed against it in the State Assembly.
Whatever it may be, both scenarios involve a possible collapse of the state government within a mere few months. But the Sultan chose the first option: to allow DAP, PKR and PAS to combine their seats and ‘outgun’ Barisan Nasional’s 28 seats by just three seats. This means a mere shift of two seats and the government of Perak will change hands.
And this did happen exactly as forecasted. And the same thing would probably have happened as well if Barisan Nasional had formed the Perak state government. And it would take just months for it to happen.
The Sultan had his reservations. Whether Barisan Nasional, or a loose coalition of DAP, PKR and PAS, formed the new Perak state government, the government would be unstable and may not be able to last. PAS held Kelantan with a one-seat majority in the Kelantan State Assembly and lasted. But PAS is different. The PAS people are more committed. We can’t say the same thing for DAP and PKR who were already quarrelling even before the government could be formed.
Note the quality of the PKR people. Even though it had more seats than PAS, it could not provide the Menteri Besar and had to pass the job over to PAS even though it had the least number of seats in the Perak State Assembly. PKR just did not have the quality people needed to become Menteri Besar of Perak. What hope can you give a party that lacks quality candidates?
The Perak situation was a crisis waiting to happen. And it would not take that long to happen. One false move and the DAP-PKR-PAS loose coalition government of Perak would collapse. And it did collapse because two of the PKR people walked into a trap and found themselves faced with corruption charges.
But the problem does not end here. What happens to the corruption charges against those two ‘independent’ State Assemblymen? Will the charges now be dropped? If the charges are dropped then it would become too obvious. But if the charges remain and they face trial, then another problem crops up.
First would be what surfaces in the trial. If the trial reveals they were fixed up, then Barisan Nasional would look bad. But if they were not fixed up and really are guilty of corruption, Barisan Nasional would also look bad. Both ways Barisan Nasional would look bad. And if they are found guilty because they really are guilty then there will be two more by-elections in Perak, which the opposition will surely win. And we will end up with 30 opposition seats against only 29 from Barisan Nasional.
This means the Perak government will again change hands like it did last week, but this time from Barisan Nasional to a loose coalition of DAP, PKR and PAS.
Then we have the problem of Hee. She is expected to resign due to the pressure she is facing. This means yet another seat will fall vacant and yet another by-election will be held.
Maybe over the 11 months since 8 March 2008, the loose coalition of DAP, PKR and PAS was running Perak with uncertainty about its future. But the new Barisan Nasional government of Perak is not on any more solid ground than the previous government. It too faces the possibility of being driven out of office.
The show is not over till the fat lady sings, goes the popular saying. And the fat lady has not sung yet. What will the final curtain be? Your guess is as good as mine. But I predict Perak will again change hands in the not too distant future. And since the Sultan of Perak has already set the trend on how governments shall change, the same formula will have to be applied once DAP, PKR and PAS, combined, have more seats than Barisan Nasional. The knife, as they say, cuts both ways.

Since 1957, whenever Constititutional monarchy is discoursed, legally speaking, it echoes the interpretation that the Sultan and the Affairs of his State are governed by the constitution. If the Sultan governs (is above) the constitution, then it’s an absolute monarchy of pre-colonial days.
The law strictly does not give any Sultan the prerogative to interpret the constitution on his own and command for its implementation, even though he is a lawyer or an ex-Lord President, unless concurred or at behest of the State or Menteri Besar.
The test is easy to apply. How could the law allows any Sultans to act on their own based on their own interpretations, for not all Sultans are lawyers. What if he insists that his unlawful interpretations should become law by invoking his so-called discretionary powers as enacted therein in the constitution?

To all, I say don't despair. Indeed it not over until it's over.
Perhaps we should put things into the proper perspectives. What we have achieved in the March 8 election is a huge milestone for the rakyat. Change, especially momentous change, takes time. Perhaps we are all too impatient for this change to happen. And I do not blame anybody for this impatience, for we have been suffering in silence for 52 years, which in anybody's book is a very very long time.
However, I do believe and faith in that change will come, if not right now, then in the next GE. It is inevitable. And there is nothing anybody can do about it, least UMNO/BN. This is what people power is all about.
But to maintain the momentum of change we must never never forget our responsibility to voice out and cast our vote come the next GE.
We shall prevail and ultimately win. The rakyat will win.

Justice? My foot! It’s a farce! Some judges are nothing more than robotic life-sucking tentacles of the dirty UMNO regime. They are accomplices to thuggery and corruption! I was appalled by the behaviour and lopsided-decisions of those judges last Tuesday in Putra Jaya. Why? Those present would tell you why.
The judges were unashamedly leaning towards the prosecution all the way! Spanners were frequently thrown at the defendant’s lawyers’ submissions giving the unmistakable impression that the outcome of the main case would be a foregone conclusion. The judges were damn lousy actors if their purpose is to put up a public display that they “do not only want justice to be done but also seen to be done”, quote and unquote Augustine Paul!
I have zero confidence with judges who have no conscience and do not practice the process of justice judiciously! “Don’t waste our time”, two of them had also proclaimed! Right, these kangaroo courts are meant only to be despised by people! Watching hawkers peddling wares is more meaningful than watching those kangaroos at play!
But still, we should be at the Palace of Injustice on Monday! Ptuuuuuuui!

- Ask to clarify why you are a threat ? How can a pen be a threat ?
- Ask to example an act of violence you have instigated by your writing ?
- Ask to justify on what ground you're a threat and to whom ?
- If they say that you are a threat to the Rakyat, than let the rakyat vote if you're a threat.
- Why is it a threat to national security to expose corruption and to seek the truth ?
If they sent you to Kamunting, let the judges know that there themselves are a threat to national security, becoz they are inciting the rakyat to rally to oppose the government for sending you to Kamunting.

As was mentioned early, the verdict by the court has already been written long before the trial started. With A. Paul sitting with the other two UMNO judges, the verdict is a foregone conclusion. Let's hope Najis will call a snap election within 1 year of takig over as PM, if he does take over. The 4th floor boys may have other plans, you never know.

I don't think Perak's PR parties lack quality people. It's just that the state constitution does not accept a non-Muslim to be MB, and the Sultan probably did not want a non-Muslim to be an MB as well. I agree with the rest of the analysis though - Perak will continue to be an unresolved issue for some time to come.

RPK, thank you for your enlightment. I can now appreciate the situation better and have great hopes of a come back from PR in Perak. Obviously, the loose coalition goofed up but I can see it was a learning experience, It is forgiveable error not due to corruption and most will look at it that way. I am ever hopeful that PR will garner even greater support next time round. Lets see how long they BN can carry on with their bribery. Good luck to your imminent court cases.

You shldn't give up - not until one million of us here do. And none of us are abt to give up on you although I admit I have given up on this country. I cannot for the life of me, see how the 3 Judges can overturn the SA HC's decision - they had no grounds to do so.

The 3 Judges shld not bow to pressure from Najis - at worst, they shld defer their decision until Year 2020 or beyond. If they upheld the Shah Alam High Court's decision of Nov 7th, they are deemed to be impartial. They shld do right for once as the SA High Ct Judge did. I salute his decision to set RPK free. I believe, in life, everything has to come to an end, incl. this fixing of court decisions by certain Judges. Everyone knows the Judiciary in Malaysia was compromised from Dr M's time - this truth makes me so ashamed of Malaysia. How can we stand proud in the knowledge that this basic human right in Malaysia called Justice was screwed & remained so after so many decades, thanks to one man?
Sometimes I wonder abt these learned men or women who are Judges - why sully your reputation permanently over money? I think it feels good to do the right thing for mankind - even though it does not bring you immense wealth. I have the utmost highest & deepest respect, regard & love for a man such as Tok Guru Nik Aziz. He is such a rare breed, he is found in the ratio of 1 in 1 billion.
Tok Guru's conscience is CLEAR, his hands are sparkling clean, his heart is pure and he is so full of compassion and wisdom, I wonder where I can find his photograph and hang it up in my home.
Not in a million years would I put up Dr M's photo or any of the bn politicians'. But for Tok Guru, even if he supported Syariah laws, or Hudud, I would love to hang his photograph inside my home. That is how much I respect him.

If you get up on the steps of the Palace and start chanting "Its not over till its over" the few of you that have the dedication to do that will be harassed by police if you are lucky and if you are unlucky it will be tear gas and chemically laced water for you. End of story.
So what can you do? Most other democratic countries would go on strike...With sufficient motivation a nationwide strike is not beyond the realms of possibility. I personally believe that clamping down on the voice of RPK is sufficiently serious to warrant a nationwide strike. But I'd guess that in Malaysia going on strike would be illegal too. If it wasnt then the malevolent vindictive government and greedy bosses would make sure that any strikers regretted their actions
So the next best alternative is to go on strike pretending that you are taking a sickie... that's aussie slang for a taking medical leave.
If enough of you act together there is nothing the evil men of Malaysia can do except plead with you to give in... and then you have them by the balls. You are in a position to negotiate
Might I suggest a couple of disease to which you might succumb
Umnosis... severe inflammation of the urinary tract resulting in repetitive urination. ie UMNO is pissing you off
BeN sodomosis... severe anal pains accompanied by either constipation or diarrhoea. ie BN is giving you the shits
The bottom line in all this is that the Law is supposed to reflect the standards of Society at large. After all that's what a democracy is all about. The Law is not created to protect the lawmakers from the people who elected them
If 59% of the population cringe at the thought of Najib as next PM then its not unreasonable to suggest that a greater percentage would wish to get rid of the ISA and its equally draconian brethren
If that's what 2/3 of you want, then make it happen... and save RPK along the way

Densemy, your points are well appreciated. But for the moment at least, I think your ideas are more suitable for the more enlightened and homogenous countries. Please do consider the fact that the people here have been tricked, brainwashed and bullied into submission for decades.
To realize your many ideas as proposed before, more people need to be at least given the experience and exposure on the streets in our case. Tear gas or water cannons are no big deal when people start learning to have courage. The MAIN challenge is to make more M'sians politically inclined and aware. And we are not getting that from the MSM like they do in other countries.
Just as we need a fantastic man like RPK as a leader and symbol, we also need a rallying call, like the DAP's 'JUST CHANGE' in the previous GE. Now we can have this 'IT'S NOT OVER TIL IT'S OVER' from RPK to unite and stimulate the people especially if he goes back to Kamunting. BTW, that lying slogan 'Malaysia Boleh' is from Mahathir.
Things have to be progressively done one step at a time in view of our delicate political and multi-cultural situation, not to mention the biased government institutions. I understand that various options have been discussed especially over the past few days.

Well, that fat lady can't sing until it's over and we won't subimt it's over until it's over! Economics locally in a mess and government is looking at elections after election and more would follow. I believe that devine is working overtime to get all politicians to scramble.
Let's see Perak, it's only tit for tat and everybody, including myself is cajoling for supports for their sides. Like you said, it won't end even after a state snap poll. I dare to be different that it will end in the coming GE13. Umno is in tatters and BN is irrelevant as we can see. Apart from Umno and MIC having their party elections, even MCA is not well in their top leadership.
The only possibility is to opt for Pakatan Rakyat to steer us malaysians out of this doldrum. Pakatan must be sincere to uphold intergerity in whatever they preached. Stop fighting among yourselves and abolish race based mentality.
These are what majority of malaysians beg to accomplished. Hopefully we would achieve it in the near and coming GE13.
DSAI, just drop the defection mentality. Don't go through the back door. Look at Perak, both might say that they are in control but actually it came to a naught for the rakyat of Perak.

In this time and era, there is no such thing as absolute monarchy. Such practices were during feudal time. Today, rulers are merely symbols and formalities in most countries including Malaysia. Our former Prime Minister, Tun Mahathir and his government successfully removed the last relevant power the rulers have. This is possible because Tun Mahathir got the support of majority of the Malaysians.
If one were to look back on what triggered the previous government to remove the rulers' power then one would not blame Tun Mahathir for his role. What Tun Mahathir did was merely the inevitable, which I believe if not done will also eventually be done by the next or future government.
The rulers themselves should take the blame for allowing some of their fellow rulers to act beyond acceptable conduct. Many were minor while some were major. Regardless they are unacceptable. There is no need to further elaborate as I am sure the rulers knows what are they and who were involved.
Recent incident in Perak see overwhemly support from the public to the Pakatan government following what were seen as an unfair and unjudge decision made by the Sultan. The feeling split over to other states. The Sultan of Perak and his son whom were once highly regarded by the people, suddenly loss the trust and respect from the very same people. The event capture the hearts of many Malaysians and this generated a lot of sympathy to the Perak's Pakatan government.
Arising for the past and also recent event, it is becoming more important for the rulers to impose self governance among themselves to ensure highest level of integrity and fairness shown by all the rulers. This is the only way to win the heart and respect from the people. It is also the only way to ensure the existence of the rulers. Don't defend the in defendable. Don't blindly take side just because they are your fellow rulers.
As for now, majority of the Malaysians are behind Nizar and Pakatan in Perak. Don't blame us for doing that. Blame your fellow ruler.

It was UMNO and Mahathir who humiliated and brought the sultan to their knees when Mahathir curbed their powers. Now UMNO is talking about daulat tuanku and disrespeting the sultans by PR.
